Terms of service

1. Purpose

These Terms of Service (hereinafter the "Terms") set out the conditions under which E1 (hereinafter "Onirelo", "we") makes the dream journal service available at https://onirelo.com (hereinafter the "Service") to any natural person (hereinafter the "User"), along with the rights and obligations of the parties in that context.

Any use of the Service implies full and unreserved acceptance of these Terms. If you do not accept all or part of the Terms, you must refrain from using the Service.

2. Description of the Service

Onirelo is a web application that lets the User:

  • record their dreams in a personal journal;
  • receive interpretations, analyses and suggestions generated by artificial intelligence from the entries they save;
  • view tags and themes automatically extracted from their dreams;
  • access a dashboard summarising their personal statistics and trends.

Onirelo is a journaling and self-exploration tool. The Service is in no way a medical device or a psychological, psychiatric or therapeutic opinion. Content produced by artificial intelligence is for strictly informational and introspective purposes only.

3. Access to the Service

3.1. Eligibility

By creating an account on Onirelo, the User declares being at least 16 years old. The Service is not intended for minors under 16.

The User also declares having the legal capacity required to enter into these Terms.

3.2. Account creation

Accessing the Service requires creating a user account. At sign-up, the User can authenticate using:

  • an email address and a password;
  • a Google account;
  • an Apple account.

The User undertakes to provide accurate information and to keep it up to date. They are solely responsible for the confidentiality of their credentials and for any actions taken from their account. Any suspicious use must be reported without delay to contact@onirelo.com.

3.3. Availability

Onirelo strives to keep the Service available 24/7, subject to interruptions necessary for maintenance, evolution, or due to force majeure. No contractual availability guarantee (SLA) is offered as part of free use. The guarantees applicable to subscribed Users are set out in the Terms of Sale.

4. User Content

4.1. Ownership and responsibility

Entries, notes and tags entered by the User in the Service (hereinafter the "User Content") remain the exclusive property of the User. The User is solely responsible for their User Content and warrants that it does not infringe any third-party rights and is not contrary to any applicable law.

4.2. Licence granted to Onirelo

In order to make the Service work, the User grants Onirelo, for the duration of their account and worldwide, a non-exclusive and free-of-charge licence on their User Content, for the following purposes only:

  • host, back up, display and present their User Content within the interface;
  • forward User Content to artificial intelligence providers, under the conditions described in the Privacy Policy, in order to produce the requested interpretations and tags;
  • produce aggregated and anonymised analyses and statistics from User Content, with a view to improving the Service and publishing general insights (for example, frequency of major dream themes across all users).

No other use of User Content may be made without the User's prior consent. In particular, User Content is never used to train artificial intelligence models.

5. Permitted and prohibited uses

The User undertakes to use the Service in a fair manner and in line with its intended purpose. In particular, the User must not:

  • attempt to access accounts or data that do not belong to them;
  • compromise the security, integrity or availability of the Service;
  • use the Service for unlawful or fraudulent purposes or contrary to third-party rights;
  • automatically scrape any part of the interface content;
  • intentionally enter content into the Service that is contrary to law (incitement to hatred, child sexual abuse material, etc.).

Onirelo reserves the right to suspend or close the account of any User who breaches these Terms, after notification and, where relevant, within a reasonable period allowing them to submit comments.

6. Artificial intelligence

The Service relies on artificial intelligence models supplied by third parties (Anthropic, OpenAI, Google Cloud Vertex AI) to generate interpretations and tags from dream entries. The exact conditions of these processing operations (purposes, legal basis, processors, transfers outside the European Union, retention period) are described in the Privacy Policy.

Analyses produced may include indications relating to the User's perceived mood or wellbeing. These indications produce no legal effect and are not used, without human intervention, to take any decision significantly affecting the User. The User may at any time request human intervention, express their point of view and contest these analyses by writing to privacy@onirelo.com.

7. Publisher's intellectual property

All elements making up the Service (trademark, visual identity, source code, interfaces, editorial content, illustrations) are protected by intellectual property law and remain the exclusive property of E1. Any unauthorised reproduction or use engages the responsibility of its author.

8. Liability

Onirelo undertakes to provide the Service with due care, without guaranteeing the total absence of errors, interruptions or defects. Onirelo cannot be held liable:

  • for damage resulting from a use of the Service that does not comply with these Terms;
  • for any failure attributable to the User, a third party or to force majeure;
  • for decisions taken by the User following an interpretation or analysis produced by the Service.

These Terms in no way limit the rights the consumer User enjoys under applicable law, notably the statutory warranty of conformity and the warranty against hidden defects.

9. Personal data

The processing of the User's personal data is described in detail in the Privacy Policy, which forms an integral part of these Terms. The User may at any time exercise their rights (access, rectification, erasure, portability, objection, restriction) by writing to privacy@onirelo.com.

10. Suspension and termination

10.1. By the User

The User may at any time delete their account from the Service settings. This deletion entails the immediate and definitive removal of their User Content, without any grace period or restoration possibility. Onirelo recommends exporting your data beforehand, following the procedure described in the Privacy Policy.

10.2. By Onirelo

Onirelo may suspend or terminate a User's access in the event of a serious breach of these Terms, after prior notice where possible. In the event of proven fraud or an immediate threat to the security of the Service or third parties, the suspension may be immediate.

11. Changes

Onirelo reserves the right to amend these Terms to reflect changes to the Service, legislation, or its practices. Users are informed of any substantial change through an in-Service message or by email, at least 15 days before it takes effect. Failing acceptance, the User may close their account before the new Terms come into effect.

12. Governing law and dispute resolution

These Terms are governed by French law.

Any dispute relating to their formation, interpretation or performance shall, failing amicable resolution, be brought before the competent French courts. In accordance with European rules, the consumer User retains the right to bring proceedings before the court of their place of domicile.

Before any court action, the consumer User is invited to refer the matter free of charge to the designated consumer mediator, whose contact details appear in the Legal Notice. They may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.
